11 марта вступили в силу поправки в региональный закон «Об особенностях регулирования земельных отношений». Этот документ, среди прочего, определяет правила выкупа земельных участков из государственной и муниципальной собственности в Калининградской области. Поправки, принятые областной Думой 14 февраля 2018 года, касаются только выкупа областной земли и участков, собственность на которые не разграничена. А точнее – определяют новую цену, по которой такие участки могут быть проданы без торгов.
Приоритетное право на льготный выкуп всегда имеют собственники зданий и сооружений, расположенных на арендуемом земельном участке. Однако новая версия закона существенно сужает круг лиц, которые могут купить участки под ними по льготной цене. Если до 2019 года как граждане, так и коммерческие организации, которые выкупили сооружения у области или муниципалитета, могли приобрести участок за 2,5 % кадастровой стоимости, то теперь для этих случаев выкупная цена участка повышается до полной кадастровой стоимости. Право выкупа за 2,5 % остаётся лишь у тех претендентов, кто в период с 2001 по 1 июля 2012 года переоформил право бессрочного пользования на право аренды земельного участка.
Другая «льгота» закона в старой версии касалась физических и юридических лиц, которые возвели «с нуля» постройки на арендованной земле и оформили право собственности на сооружения. Такие претенденты могли выкупить участок по цене равной десятикратной ставке земельного налога. Однако судебная практика показала, что зачастую никаких построек на участках не было. Один из недавних примеров – возвращение в областную собственность 40 га в Гурьевском городском округе, проданных в 2016-2017 годах Михаилу Корнакову.
Сейчас право заключить договор купли-продажи по цене, равной десятикратной ставке земельного налога остаётся у юридических лиц, если участок был предоставлен им ранее по распоряжению губернатора для реализации инвестиционного проекта. «Льготные» цены также сохранились для граждан, претендующих на выкуп участка под личное строительство и для некоммерческих организаций.
Новые поправки формально направлены на повышение доходов областного бюджета, но едва ли серьезно повлияют на известную практику выкупа земли за бесценок. В первую очередь из-за того, что все, кто мог реализовать подобную схему уже сделали это в предыдущие годы, полагает адвокат, член Федеральной палаты налоговых консультантов Ольга Ярославская. Сама практика выкупа областной земли по 2,5 % кадастровой стоимости была введена в 2010 году при губернаторе Георгии Боосе.
«Думаю, что таких, кто имея право аренды, хочет выкупить еще землю, осталось немного. У меня вот так на памяти буквально единицы. И то не уверена, что они что-то будут предпринимать. В принципе, все, кто желал это сделать, сделал это давно», – отметила адвокат.
Отметим, что закон «Об особенностях земельных отношений» был пересмотрен по инициативе правительства Калининградской области в преддверии новой кадастровой оценки земель госсобственности. В 2019 году должно состояться определение кадастровой стоимости земель поселений, в 2020 году – земель сельхозназначения. Годом ранее правительство провело переоценку в отношении земель промышленности и участков специального назначения.
